GTC will not be responsible for any and all liability , costs, damages or causes of actions which result from any use of the contracted services. 3. Invoices must be paid within 30 days of receipt. Services payments will be absolute and unconditional in all events and will not be subject to any set-off, defense, counterclaim, or reimbursement, for any reason whatsoever. A late payment fee equal to the maximum amount allowable by law will be charged against any account for any payments of any amounts due hereunder that are not received within thirty (30) days of the date of the invoice. 5. Customer shall pay when due, all charges and taxes (local, state, federal) which may now or hereafter be imposed on the possession or use of the service, excluding, however, all taxes on or measured by GTC income. 6. A pro rata credit allowance will be made for any interruptions in the DSL service of 24 hours or more. 7. The service term will commence on the date of installation. The term will continue in full force and effect for twelve months from the date of installation. Valstar DSL must be in service for twelve (12) months. If canceled prior to twelve (12) months of service, the customer account will be charged a penalty fee. This fee is equivalent to the cost of the modem (if not returned in working condition) plus the difference between the monthly price and the yearly price for the term of the service plus the cost of the installation. If Valstar DSL is canceled for any of the following reasons, the penalty fee will be waived. * If the customer moves out of a DSL capable area into an area not served by DSL. 8. Customer shall provide GTC with thirty (30) days prior written notice of its intention to terminate this services. 9. If the customer moves from a DSL capable area to a DSL capable area and wishes to have DSL installed at the new location, the customer will be liable for any installation costs at the new location (unless the special promo offer is in effect in the new area). |
